Could You Explain To Me What A Debt Settlement Is?
Advertisment
Debt settlement is a process in which negotiations are made between a customer and a debtor to alter the payment of debts usually to avoid bankruptcy.
The process is a much better alternative in most cases to bankruptcy. Debt settlement is an option that is available for credit card debts. Unfortunately, it is not an available option concerning student loans, tax debts, automotive loans, and mortgages.
Hector Milla Editor of the “Best Debt Settlement Companies” website — http://BestDebtSettlementCompanies.org — pointed out;
“…The process results in a more positive outcome for both the debtor and the creditor than the option of declaring bankruptcy. The debtor is able to avoid the adverse consequences of bankruptcy including the evasive court-mandated controls which would be placed on the debtor’s finances as a result of bankruptcy…â€
The debtor would also be able to reduce his debts by as much as fifty percent in some cases. Creditors also have many advantages to utilizing the settlement process. First, the creditor is assured that they will receive some of the money that is owed to them by the debtor. If the debtor were to declare bankruptcy, the creditor would stand to loose a significant amount of their investment. The creditor is also able to claim tax credits for forgiving debt. In a bankruptcy situation, the company would not be able to claim such a credit.
“…There has been a stigma attached to the settlement process by many people that the process will have an adverse effect on one’s credit report. The rumors of the impact of a settlement upon one’s credit report has been greatly exaggerated. In reality, evidence of a settlement would appear on one’s credit report, but the effects of a settlement would be much less drastic than a bankruptcy. The appearance of a settlement could possibly portray to some creditors that the customer is willing to take necessary steps to repay debts without resorting to bankruptcy…†added H. Milla.
Debt settlement has many benefits to both creditors and debtors. This provides for an attractive option in many situations to avoid bankruptcy cases.
